Terms of Service

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Botifily is a platform for training an AI agent on content you provide and deploying it across channels such as a website widget, WhatsApp, Slack, and email. We may add, modify, or discontinue features of the Service at any time.

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

Paid plans are billed in advance on a recurring basis as described at checkout. Fees are non-refundable except where required by law. We may change fees on renewal with at least 30 days' notice.

You agree not to use the Service to:

• Train or deploy a bot that violates applicable law or infringes on the rights of others.
• Attempt to gain unauthorized access to the Service or its underlying systems.
• Reverse engineer or attempt to extract the source code of the Service, except as permitted by law.
• Resell or sublicense access to the Service without our prior written consent.
• Use a connected channel (e.g., WhatsApp) in violation of that provider's own policies.

You retain all rights to the content you upload and the conversations your bot has ("Your Content"). You grant us a limited license to host, process, and transmit Your Content solely as necessary to operate the Service, including sending it to the AI model provider and the channels you configure.

Your bot generates responses using a third-party AI model based on the content and instructions you provide. AI-generated output may be inaccurate or incomplete; you are responsible for reviewing your bot's configuration and responses before relying on them for decisions with real-world consequences.

The Service, including its software, design, and Botifily trademarks, is owned by Botifily and its licensors. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTIFILY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

You may cancel your account at any time. We may suspend or terminate your access if you materially breach these Terms and do not cure the breach within 15 days of notice.

These Terms are governed by the laws of the State of CA, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in San Jose, CA.

We may update these Terms from time to time by posting the revised version on the Service. Material changes will take effect 30 days after notice.
